2. ACCEPTANCE OF THE CONDITIONS
The customer acknowledges having read the General Conditions of Sale at the time of the order and declares to accept them without reservation. These general conditions of sale govern the contractual relations between CLICHÉ and the customer, with both parties accepting them without reservation. All orders placed with CLICHÉ are intended for the personal use of customers, who prohibit any partial or total resale of the products. These General Conditions of Sale prevail over all other conditions appearing in any other document, unless prior, express and written waiver.
CLICHÉ reserves the right to modify these General Conditions of Sale. However, the General Conditions of Sale applicable to the Order are those accepted by the Customer at the time of placing the Order. Any new version of the General Terms and Conditions will take effect immediately on its publication date and will govern any purchase made from that date.
3. PRODUCTS
The photographs illustrating the products are not contractual in nature, slight variations in colors and shape may occur. In this case, CLICHÉ cannot be held responsible. Furthermore, any weights indicated on the item sheets are given as an indication and may vary from one piece to another depending on the level of polishing and the size of the rings.
4. ORDER
Automatic order recording systems are considered proof of the nature, content and date of the order. CLICHÉ confirms acceptance of the order to the email address provided by the Customer. The sale is only concluded upon this confirmation. CLICHÉ reserves the right to cancel any order from a customer in the event of a dispute relating to the payment of a previous order. The information provided by the buyer when ordering is binding on the buyer: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
5. DELIVERY
After confirmation of the order, CLICHÉ undertakes to ship all references ordered by the buyer to the carrier within the deadlines specified during the purchasing process. The deadline indicated on the item sheet begins upon receipt of full payment for the order. The carrier undertakes to deliver the order to the address provided by the buyer. For deliveries outside mainland France, the customer undertakes to pay all import taxes, custom duties, VAT, and other taxes applicables according to the laws of the country in which the order is received.
CLICHÉ disclaims all legal liability in the event of non-payment of taxes by the Customer.
Delivery will be made by a specialized carrier, with direct delivery of the product to the recipient or his representative against signature, or, depending on the choice when ordering, delivery to the nearest post office or relay point, where the package can be withdrawn against signature. Possible delivery delays do not entitle the buyer to claim damages.
Deliveries outside France may result in additional costs payable by the Customer. In the event of apparent defects, the buyer has the right of return according to the conditions provided in this document. Cases of force majeure, that is to say an irresistible and unforeseeable event such as war, riot, fire, strike, accidents, and impossibility of supply, relieve the seller of his obligation to deliver.
It is recommended to check the package upon arrival. In the event of missing items or damage, reservations can be made to the carrier within 48 hours.
6. REFUNDS
You have 14 clear days from receipt of the items to form an opinion. In the event of an exchange or refund, return the new items in their original packaging, intact, accompanied by all possible accessories and documentation to the following address: Atelier Benoit, 10 rue de la paix, 75002 PARIS, FRANCE.
7. PRICE
The price is expressed according to the currency chosen by the Customer. The price indicated in the order confirmation is final, all taxes included, including VAT for France and the countries of the European Union. CLICHÉ reserves the right to modify its prices at any time, without notice. The new prices are applicable to orders placed as soon as they are put online on the Website www.clichejewels.fr. The prices do not take into account delivery costs, delivery costs are fixed and the amount of delivery costs is indicated to the Customer before validation of their order.
8. PAYMENT
The price invoiced to the Customer is that indicated in the order confirmation sent by CLICHÉ. The price of the products is payable in cash on the day of the actual order. Payment is made by credit card (Visa, Mastercard, American Express, Discover, Diners Club, JCB and China UnionPay) via the secure payment solution provided by Stripe. Thus the bank card number is directed to the bank's servers, and payment is made directly to the bank in a secure environment, guaranteeing that your numbers are known only to our banking partner. The order validated by the Customer will only be considered effective when the bank payment centers have given their agreement. In the event of refusal, the order will be automatically canceled and the Customer will be informed by email. Furthermore, CLICHÉ reserves the right to refuse any order from a Customer with whom there is a dispute.
9. DISPUTES
This contract is governed by French law. CLICHÉ declines all responsibility for material, immaterial or bodily damage resulting from a malfunction or misuse of the products sold. In any event, CLICHÉ's liability is limited to the amount of the order and cannot be incurred for simple errors or omissions despite the precautions taken in the presentation of the products.
In the event of difficulties in the application of the contract, the buyer may seek an amicable solution, in particular with the help of a professional association of the sector, a consumer association or any other advice of his choice, before any legal action. You also have the option of using a consumer mediator. The search for an amicable solution interrupts neither the period of the legal guarantee nor the duration of the contractual guarantee. As a general rule, and subject to the discretion of the Courts, compliance with the provisions of this contract relating to the contractual guarantee presupposes that the buyer honors its financial commitments to the seller.
Complaints or disputes will always be received with kindness, good faith being presumer in those who take the trouble to explain their situation. In the event of a dispute, the Customer must first contact CLICHÉ to obtain an amicable solution. Failing this, the Paris Commercial Court has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
10. WARRANTY
All CLICHÉ products are guaranteed against any manufacturing defect for a period of two years. CLICHÉ undertakes to refund in full any products that do not conform. This warranty does not cover wear and tear due to use, nor does it cover breakage or deformation resulting from accidental circumstances or improper use. In any event, CLICHÉ cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country. CLICHÉ's liability is systematically limited to the value of the product in question, on the date of sale, without the possibility of recourse against the brand or manufacturer of the product. In any case, the Customer benefits from the legal guarantee of eviction and hidden defects (articles 1625 and seq. of the French Civil Code). If the buyer proves the existence of a hidden defect, the seller is legally required to repair all the consequences (articles 1641 and sequencing. of the French Civil Code). The buyer must take legal action promptly following the discovery of the hidden defect (article 1648 of the French Civil Code). For any questions, you can contact customer service by email at contact@clichejewels.fr.
11. LEGAL INFORMATION
The provision of personal information collected for distance selling is mandatory, this information being essential for the processing and delivery of orders, as well as for the establishment of invoices and warranty contracts. The absence of information results in the non-validation of the order. The Customer has a right of access, modification, rectification and deletion of data concerning him which he can exercice with CLICHÉ. In addition, CLICHÉ undertakes not third parties, free of charge or in exchange for compensation.
